Driver Who Killed Cyclist Not Charged

Court records show that the woman had driving infractions, but has not been charged in the death of cyclist Eric Billings of Rancho Santa Margarita.

A Mission Viejo woman who hit and killed a cyclist Friday has not been charged with his death, according to court records.

Hasti Fakhrai-Bayrooti, 39, was driving a 2009 Acura south on Santa Margarita Parkway near Trabuco Hills High School when she hit and killed Eric Billings, 54, of Rancho Santa Margarita, according to the Orange County Sheriff's Department.

Fakhrai-Bayrooti has not yet been cited or charged in the killing, based on records from the Orange County Superior Court.

The driver had two past driving infractions. In Oct. 2009, Fakhrai-Bayrooti was ticketed for speeding over 65 mph. She did not attend traffic school for that infraction.

In June 2011, Fakhrai-Bayrooti received a ticket for driving while on a cell phone.

Billings has been described by friends as a devoted family man and committed member of the Church Jesus Christ of Latter-Day Saints, as well as the owner of a small construction company.
