Keeping Public Beaches Public

Restricting access to public beaches sparks heated debate in Dana Point.

One of the many benefits of living in Mission Viejo is its nearness to beautiful local beaches. Laguna Beach, San Clemente and Dana Point are just a 15-minute drive when the mood strikes, especially in these summer months.

Unfortunately, some are not too keen on the restricted access to the beach caused by the million-dollar homes at Strand at Headlands in Dana Point. The city has put up gates that are only open from 8 a.m. until 5 or 7 p.m. depending on the time of year. Residents of these homes are concerned about public nuisances so close to their homes.

According to the Orange County Register, the Surfrider Foundation filed a lawsuit against the city. The lawsuit claims that the restrictions violate the “maximum beach access” afforded in the California Constitution.

The city of Dana Point was ordered to get the approval for the gates from the California Coastal Commission by Superior Court Judge M. Joan Lewis. According to an article in the Huffington Post, Judge Lewis asked, "Why should beach access to the public be denied in favor of a private property owner's interests? The Coastal Act contains a goal of maximizing public access and recreation."

Judge Lewis ruled that the  claims of public nuisance were not proven. Despite the judges ruling the gates still stand. So what do you think?
