He is survived by his wife Sally Wallerand their two children.

A memorial website dedicated to Waller has drawn messages of support from those who knew him. One commenter, called "Sta47Chief," left the following:

On behalf of the Westminster Police Department, we offer our deepest sympathy to you and our thoughts and prayers are with you during this difficult time. Mitch was an extraordinary public servant who gave so much to his community and to everyone who had the honor of knowing him. There are no words to express the depth of our gratitude for his selfless leadership and service to the City of Westminster.
