Caretaker Arrested in Alleged Sex Assault on 80-Year-Old

Mission Viejo man is taken into custody after alleged sex acts with an elderly client.

Updated at 6:30 p.m. Monday to clarify the alleged crime and add comments from a company that had employed the arrestee. 

Caretaker Domingo Rabino, 49, of Mission Viejo was arrested Saturday for alleged oral copulation, finger penetration and assault with intent to commit rape of an 80-year-old Laguna Niguel woman.

Rabino had previously cared for the woman's husband, who died in February, and was rehired by her family on May 2 to care for the woman, authorities said. According to Jim Amormino, O.C. sheriff's spokesperson, there were two incidents.

On one visit to the house, Rabino was giving the woman a theraputic massage when he penetrated her with his finger, Amormino said. On the next visit, Rabino again penetrated her with his finger, and performed oral copulation, Amormino said. The suspect also tried to have intercourse with the victim, Amormino said. Although that act didn't meet the legal definition of rape, it did allegedly involve partial penetration, which is called assault with intent to commit rape, Amormino said.

Rabino has been employed by Amada Home Care, but was working freelance for the victim, authorities said. Amada issued a statement saying it had hired Rabino "intermittently" and only to work with male clients and wasn't involved with this victim's care. The company said it was "cooperating fully with the Sheriff’s Department, as we ourselves would like to see justice and protection for the elderly who we are here to serve."

Rabino is a resident of Mission Viejo, but stays overnight with some of his clients, Amormino said. "Because he takes care of the elderly, we fear there are other victims," Amormino said.

Rabino was later released after posting $100,000 bail.
