Man Shot Deputy with BB Gun During Eviction, Authorities Say

A 46-year-old Laguna Hills man pleaded not guilty Monday to shooting an Orange County sheriff's deputy in the hand with a BB gun as he was being evicted from his home, according to an Orange County prosecutor.

Randal Jon Rose pleaded not guilty to three felony counts of resisting and deterring an executive officer by force and misdemeanor counts of brandishing an imitation gun, assault on a peace officer and battery on an officer, Deputy District Attorney Brock Zimmon said.

Orange County sheriff's deputies were sent about 9 a.m. Thursday to Rose's home in Laguna Hills to evict him, Zimmon said.

When Rose refused to answer the door and a locksmith was unable to undo a lock, the deputies broke a window to a spare bedroom to get in the home, Zimmon said.

Rose, who was kneeling in his living room, allegedly pointed a black BB gun at the deputies as they approached from a hallway, Zimmon said.

Rose allegedly failed to comply with orders to drop the weapon, so the deputies tried to subdue him with a Taser gun, Zimmon said.

Despite being shot with the Taser gun, Rose fired the pellet gun at deputies, hitting one in the hand, Zimmon said. Another deputy fired a weapon at Rose, but did not hit him, according to Zimmon.

Deputies were able to take Rose into custody after shooting him again with a Taser, Zimmon said.

A judge set $100,000 bail for Rose, rejecting prosecutors request for $150,000 bail, Zimmon said.

Rose could face up to three years in prison if convicted. He is next due in court May 24.
