City Refuses Claim for Fence-Smashing Tree

A homeowner asked for $20,000 after a city tree fell on his fence. The City Council voted to refuse his claim Monday.

A homeowner will have to go to court if he wants the city to pay for damages to his wall and fence.

On Monday, the City Council voted to deny Michael Muno the $19,400 he says he spent to repair a fence and wall damaged by a city-owned eucalyptus tree on a public slope. For many cities, denying such claims is routine.

It was 3:15 a.m. Dec. 1 last year when the tree crashed into Muno's fence.

Muno says it cost $1,450 to demolish the damaged wall portions, $5,900 to remove the top two layers of the wall, another $3,150 to add new capstone, and $8,900 to finally replace the four-foot-tall wrought iron fence.
