Judge: OC Birther Orly Taitz Can’t Stop Obama’s Swearing-In

In careful detail, a federal judge explains why South Orange County's realtor/birther/dentist/lawyer Orly Taitz picked the wrong avenue to fight President Barack Obama's swearing-in.

MISSION VIEJO, CA -- Is Barack Obama the legitimate president of the United States? Can he be sworn in Sunday?

In lawsuit after lawsuit, South Orange County's Orly Taitz has repeatedly said ‘no.’

Taitz, who has claimed residence in Laguna Niguel, Aliso Viejo and Rancho Santa Margarita, lost her latest legal battle in federal court Wednesday as she sought to bar the president's swearing-in.

Her claim that Obama "committed treason, fraud or conspiracy to fabricate proof that he is a natural born American citizen" is "legally untenable," wrote U.S. District Court Judge Morrison C. England, Jr. in the 13-page order.

England said Taitz should have taken up her claim with the U.S. Congress, for "the Constitution gives Congress, and Congress alone, the power to remove the President."

The court has no say in the matter, England said: "The Court cannot require that President Obama present, or even possess," a birth certificate or social security card.

In the decision, England lists five cases rejected by other courts that claim Obama is ineligible to serve. Then he names seven more failed cases filed by Taitz.

Why have the cases failed? Taitz said during the hearing it has been the work of "dishonest and corrupt judges."

England disagreed.

"Plaintiffs have failed in the Courts, and will undoubtedly continue to fail in the Courts, because they ask the Court to supplant the legislative branch and disregard the fundamental doctrine of separation of powers," he wrote.

I bet you haven't ever viewed the MCSO 1.5 hour video presentation on the findings of their investigation that documented forensic and scientific proof that Obama's BC and selective service reg card are both as phony as 3 dollar bills, have you Mr. Brain Stem? It's easy to attack the messenger. It's much harder to attack the FACTS. heh. They explained it in such a way that a 3rd grader could understand the damning evidence. Shripathi, I left short of my degree to join Officers Training in The USMC during the early Vietnam era. I have never claimed to be an university graduate though I hold four diplomas in Silcon Wafer Processes. The University of Alabama thought enough about my life efforts for the university, civic activities and this combined with my worldwide success in developing high technology business, that their Executive Board voted me in as a National Vice President of the University of Alabama Alumni Assn. I know plenty of incompetent politicians with degrees holding public office. Shutting down the negative mud slinging politicians and their ardent supporters (most all of them hiding behind aliases) is not worth the effort. Thanks for your offer! Politicians like me as much as I like them because I expect honesty and integrity.

Herbert Hoover had a foreign born parent and he's WAY after the signing of the constitution. Examples of foreign born parents....Andrew Jackson (1829-1837) is the only president born of two immigrants, both from Northern Ireland. Presidents with one immigrant parent are Thomas Jefferson (1801-1809), whose mother was born in England, James Buchanan (1857-1861) and Chester Arthur (1881-1885), both of whom had Protestant Irish fathers. Arthur's mother was born in Vermont, but her family moved to Canada and that is where she met her husband and where they lived before moving to the US together. Woodrow Wilson (1913-1921) and Herbert Hoover (1929-1933), whose mothers were born respectively in England and Canada.

Because even if you did, people might ask for the "original attendance records" printed on paper with ink available at that time, and it'd never end. I always thought that it was very strange that a scholar like Barack Hussein Obama refused to publicly disclose his college transcripts and records. I mean, gee, even George W. Bush, who was not regarded as a scholar, was more than happy to release his. Consequently, I can only logically assume that Barack Hussein Obama has something to hide. Something that he doesn't want us to see. If he were REALLY that interested in his PRIVACY he wouldn't have run for POTUS in the first place. Besides, he has proven to us so many times that he is a repeated liar that his refusal to share his collegel records with us just reinforces my belief that he is probably not entitiled, by law, to be our POTUS. But since we are a manipulated and gamed nation, the ones who should call him out refuse to do it. And, as I've said so many times before, the laws were made only to be obeyed by the little people. The evidence is overwhelming.

Absolute baloney. George W. Bush released his transcipts from Yale University. It was the talk of the town for a week. People were criticizing him for being a very average student. Yet Barack H. Obama hides his college transcripts yet prides himself on being this big constitutional scholar. He wasn't even able to articulate the Marbury vs. Madison case which a 2nd year law student should know by heart. heh. Obama is a fraud. Inside and out. In many, many ways. Any casual observer with common sense could see that.

How many people have actually edited the Harvard Law Review? How many of them were African-American? How many of them were anything other than white men? Reagan looks pretty liberal these days and I doubt Republicans would elect him. And I'll debate you on him being a leader. He wasn't. The last real leader this country had was FDR. Reagan, like the rest of them, was just good at spin: "mistakes were made." That's a direct quote from your leader. Notice the lack of a noun in that sentence. It's perfect deniability. Only a snake-oil salesman would make such a statement. A real leader would have taken responsibility and then gotten to the bottom of the gun running, money laundering problem his administration was facing.

its not that he's not a citizen but due to his father being Kenyan born, he's not considered a "natural born citizen" which requires both parents to be US citizens. Although John McCain was not US born, both of his parents were making him a natural born citizen.

Yes, he is an American citizen but most anti-Obama people, including myself, dislike his complete lack of regard for the Constitution. I could give a rat's @$$ about his color. He came out of nowhere as a freshman senator who missed a large percentage of senate meetings to become POTUS?!!! Who else with so few credentials has pulled that off? That's why there is suspicion that he was "placed" and not elected.

Anyone with any independent and truly pure intentions for the US was squashed down and ignored by the media- like Ron Paul. That candidate for the Green party was not allowed to attend the republican debate.

Bush '41 was a good and decent man. A war hero and a gentleman. And very intelligent. Bush '43 was pretty much a spoiled idiot who rode the coattails of his old man. He really had no business being President. He never really accomplished much. In fact, he destroyed most of the opportunities handed to him by his family. He nearly took the entire nation down financially. The only reason he was elected was because he was a member or the Bush family. He ruined any opportunity for Jeb to run for that office. Not that Jeb would be any better IMO.

If he's so smart, then why are his school records sealed? Why are all (normally) public records sealed? Doesn't that strike anyone as odd? I don't think its racist to demand some transparency from the person who holds the highest office in our country.

Don't forget, "media" does not necessarily equal journalism. Actual journalism seems to be absent in most mainstream media. And, any investigative reporting seems to met with ridicule, if the results of one's research are not politically correct.

Lisa, His school records aren't sealed. It's a privacy matter. You can't get anyone's. Mine, yours if you went, etc. But use your head. Google what sort of LSAT scores you need to get into Harvard Law. Then ask yourself what sort of GPA you'd need to be able to edit the Harvard Law Review. O'bama did both. How did you distinguish yourself academically?

The issue here is one of honesty, not intellegence. If 44 wasn't a globalist puppet, the easiest thing in the world he could get support for and pass would be Glass-Steagall, because this targets the financial 1% that made money the not honest way, and ultimately if an FDR rebuilding came next would be the thing to most help those who voted for him, along with most everybody else.
