Scaled Down Party Noise Law Set for Vote

A pared-down noise ordinance would assess specific fines rather than charge partiers with unlimited law enforcement costs.

A lot of noise was made over the last party ordinance. On Monday a new, more limited party noise law will get the Mission Viejo City Council's attention.

The new law is "pared down" to address community concerns of overreaching, City Attorney Bill Curley said in a staff report. The first law would have charged violators for law enforcement costs, potentially including the cost of helicopters and police dogs.

The new party law sets specific fees for each offense, which would be funneled into a law enforcement account "to assist in funding excessive service demands."

Here's how police will use the new law if passed:

  • First response and warning; no charge. The responding law enforcement personnel is expected to use professional discretion as to the need to use the new ordinance.
  • First response after warning has been issued: $250.
  • Second response after warning has been issued: $500.
  • Third response and all additional after warning has been issued: $750.
