Train Crash Victim's Family Seeks $5M from Mission Viejo

After the Sept. 9 death of former Mission Viejo High School student Anastasia Bolton, 17, the victim's family is asking for $5 million in damages from the city of Mission Viejo.

City staffers are recommending the city not pay the damages requested from Stephanie Bolton, whose relationship to Bolton was unclear based on city documents.

On Sept. 9 2010, former Mission Viejo High School student Bolton, 17, was struck and killed by a commuter train traveling beneath the Alicia Parkway overpass. Her friend Daniel Akins, 22, of Mission Viejo, was also killed.

The City Council will vote on the settlement Monday night at its 6 p.m. meeting.

In other news, a jogger and his wife are seeking unspecified damages after the husband was struck by a vehicle at the La Barca/Marguerite Parkway intersection.

According to their claim, Gregory Schaefers suffered various injuries from the Sept. 1 accident, including a broken jaw, brain hemorrhage, broken vertebrae and the loss of his senses of taste and smell.

The couple contend that a "dangerous road design" at that intersection is responsible for the accident.

The staff has recommended that the city reject their claim.
